A drunken yob has been jailed after choking a man until he was unconscious and then brutally kicking his head.

Mark Porter carried out the assault outside the Onyx nightclub, Churchgate, in the city centre, just after 6am on June 5.

Both the 24-year-old defendant and the victim were earlier warned by the police to go their separate ways.

Porter, of Herrick Road, off Welford Road, Leicester, was jailed for two years and four months after admitting causing actual bodily harm.

Mark Bishop, prosecuting, said the victim refused to leave the scene after the police left the area and pursued Porter along Churchgate.

CCTV footage played in court revealed it was the victim who threw the first punch and the pair grappled on the ground, before Porter got the better of him, pinning him down in the middle of the road.

Mr Bishop said: "Footage shows the defendant holds him around the throat and punches him on the face, as the victim tries to punch him back.

"A minute later the defendant is still holding the victim around the neck and applies pressure with both hands and we can see the victim's hands, which were up, drop to the ground.

"He's unconscious and there's no movement.

"The defendant keeps his grip and punches his face, while he's unconscious."

The injured man refused to make a statement, but allowed officers to photograph his injuries. It is not known if had any continuing medical problems.

Leicester Crown Court was told Porter had several convictions for assaults, including fighting in the street, assaulting a man in a pub and a racial attack on a fast-food store manager, between 2005 and 2008.

At the time of this latest attack he was on licence after a two-year sentence imposed in 2008.

Philip Bown,mitigating, said: "When sober he's a man who's polite, amenable and you wouldn't think capable of amassing these previous convictions and behaving in the way you see on the film.

"His remorse is genuine.

"Following his release on October 29 last year, he resolved to be sober and remained so until this incident.

"He did not throw the first punch and the injuries caused are not the most serious."
